Terms of Service

Heyvently is for people 18 years of age or older.

The 18+ requirement is an eligibility rule. Heyvently does not represent that it can reliably verify the age of every visitor.

Heyvently provides an anonymous place to publish short messages, thoughts, experiences, feelings, questions, and other permitted content.

The service may include:

• anonymous vent submission;
• a public Wall;
• country-based Wall views;
• a Support directory containing crisis and emergency resources;
• community feature suggestions and voting;
• reporting and moderation tools;
• donations; and
• sponsorship opportunities.

Features may change, be suspended, or be discontinued.

You do not need to create a public account or provide an email address to publish a normal vent.

Anonymous publication means your public post is not displayed with your name or profile. It does not mean Heyvently has no technical records. Security, moderation, infrastructure, and legal records may exist as described in the Privacy Policy.

You are responsible for the information you choose to publish.

You retain ownership of content you submit, to the extent you have rights in that content.

By submitting content, you grant Heyvently a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, moderate, and otherwise process that content as reasonably necessary to operate, secure, moderate, and improve the service and to comply with law.

This licence ends when the content is deleted or no longer required, except to the extent continued processing is reasonably necessary for legal, security, moderation, audit, backup, or other legitimate purposes.

You represent that you have the rights necessary to submit the content and that your submission does not knowingly violate another person's rights.

Vents are intended for public display.

Do not submit:

• passwords or authentication credentials;
• payment-card or banking information;
• private addresses or contact details;
• another person's confidential information;
• information that could put you or another person at risk; or
• anything you do not want other people to read, copy, or redistribute.

Heyvently cannot control screenshots, copying, quotation, or redistribution after content is publicly displayed.

You must not use Heyvently to:

• threaten or facilitate violence;
• harass, stalk, intimidate, or target another person;
• publish private personal information for intimidation, exposure, or harm;
• sexually exploit or endanger a child;
• publish or distribute non-consensual intimate imagery;
• impersonate another person for fraud or abuse;
• commit or facilitate fraud, scams, phishing, blackmail, or extortion;
• distribute malware or malicious code;
• coordinate harassment or abuse;
• manipulate feature votes or other platform mechanisms through abuse, automation, or coordinated deception;
• evade moderation or rate limits through technical abuse;
• encourage, instruct, glorify, or facilitate serious self-harm;
• encourage, instruct, or facilitate serious harm to another person;
• unlawfully infringe intellectual-property or other legal rights;
• use the service for unlawful activity; or
• interfere with the operation or security of Heyvently.

Discussion of difficult emotions, grief, depression, anger, fear, trauma, relationship problems, or other negative experiences is not by itself prohibited. The Community Guidelines explain the distinction between expressing distress and content that creates a safety or abuse risk.

Heyvently may review content and take action when reasonably necessary to enforce these Terms, the Community Guidelines, the Safety & Reporting Policy, or applicable law.

The current report flow provides two report reasons:

1. Inappropriate content
2. Harassment or harmful behaviour

A successful report currently displays: The post has been flagged for review.

Reporting does not automatically hide or delete a post.

Submitting a report does not guarantee that content will be removed. Heyvently may investigate, take no action, restrict content, remove content, preserve relevant records, or take other appropriate action.

Heyvently does not promise continuous human review or a particular response time.

A post creator may be able to request deletion using the private management token provided for that post.

You are responsible for keeping that token private. Heyvently cannot guarantee recovery of a lost token.

Deletion may not instantly remove every copy from backups, security logs, moderation records, or systems outside Heyvently's control.

The Support directory provides information about crisis, emergency, and support resources.

It is not an emergency-response service, crisis hotline, medical service, legal service, or substitute for professional care.

Information about external organisations may change. Heyvently does not guarantee that every external resource is available, appropriate to your circumstances, or able to respond immediately.

If you are in immediate danger, contact your local emergency service or another appropriate emergency resource.

Heyvently may accept donations through a third-party payment provider.

Donation amounts, payment methods, currencies, availability, and processing are subject to the information displayed at the time of payment and the applicable provider terms.

A payment may be delayed, rejected, reversed, refunded, or otherwise affected by payment-provider rules, fraud controls, banking systems, or legal requirements.

Heyvently may offer sponsorship opportunities. Any sponsorship minimums, pricing, increments, required information, display rules, and acceptance criteria will be stated in the sponsorship flow.

A sponsorship submission does not necessarily guarantee publication. Heyvently may reject, suspend, modify, or remove a sponsorship where necessary to protect users, comply with law, or maintain the service.

Payment processing is handled through Paystack or another disclosed provider. Provider terms may apply separately.

Heyvently relies on third-party infrastructure and services, including payment services. Your use of those services may be governed by their separate terms.

Paystack's current merchant terms state that Nigerian sole proprietors and other eligible persons/entities in Nigeria may create Paystack accounts, subject to Paystack's requirements.

Heyvently's name, branding, software, design, graphics, interface, documentation, and other original materials are owned by or licensed to Heyvently and are protected by applicable law.

You may not copy, modify, distribute, reverse engineer, scrape, frame, or commercially exploit Heyvently's protected materials except as permitted by law or with permission.

Heyvently is provided on an evolving basis. We may change, suspend, or discontinue any feature, temporarily or permanently.

We do not guarantee that the service will always be available, uninterrupted, secure, error-free, or compatible with every device.

We may perform maintenance, security updates, or other operational work without prior notice where reasonably necessary.

To the extent permitted by applicable law, Heyvently is provided on an “as is” and “as available” basis.

We do not guarantee:

• that every post is accurate, truthful, or reliable;
• that content will remain available for the full intended period;
• that all reports will result in enforcement;
• that external support resources will always be available;
• that the service will be uninterrupted or error-free; or
• that use of Heyvently will produce any particular personal, emotional, financial, medical, legal, or other outcome.

Nothing in these Terms excludes or limits a right or remedy that cannot lawfully be excluded or limited.

To the maximum extent permitted by applicable law, Heyvently will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from your use of the service, except where such liability cannot lawfully be excluded.

Nothing in these Terms limits liability for matters that applicable law does not permit us to limit, including liability that cannot legally be excluded or restricted.

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, costs, and reasonable expenses arising from your unlawful use of Heyvently, your violation of these Terms, or your infringement of another person's rights, except to the extent caused by Heyvently's own unlawful conduct or liability that cannot legally be shifted to you.

These Terms are governed by the laws of the Federal Republic of Nigeria, without excluding any mandatory legal protections that apply to you.

Before commencing formal proceedings, you should contact us at heyvently@gmail.com so we can attempt to resolve the issue.

Nothing in this section prevents a person from exercising a statutory right to complain to a regulator or seek a remedy that cannot lawfully be restricted by contract.

We may update these Terms when Heyvently, its features, or applicable legal requirements change.

Material changes will be reflected in the published Terms with an updated effective date. Continued use of Heyvently after an update means you accept the updated Terms to the extent permitted by law.
